Eighty Percent of Small Claims Court Cases and Small Claims Judgments Are Not Pursued
Small Claims Court » Eighty Percent of Small Claims Court Cases and Small Claims Judgments Are Not Pursued
This is such a familiar story for most Americans:
- Somebody did you wrong
- You take them to small claims court
- The judge or the magistrate decides in your favor
- You don't get any compensation.
Although the small claim court is structured to allow you to get your money back in court, nothing in the manual says that it is easy. The court system offers you fairly generic information on filing wage garnishments, bank garnishments, liens, and other methods of getting back what is owed to you that you were awarded in court, however that information will not teach you everything you need to know. So that leaves us with only a few choices:
- Let the debtor win (Never recover your money)
- Spend several weeks trying to learn how to get your money back yourself
- Talk to an attorney and pay a retainer plus hundreds per hour fees
- Hire a Collection Agency
Although debt collection service isn't hard to figure out once you learn how to do it, the process will save you time and money in the long run. You would think that once you were awarded judgment, they would make it easier for you to collect the funds that are owed to you.
Small Claims Courts offers pamphlets to you explaining debtors rights. Try to ask one of the court clerks how you find the bank information of the debtor or the process of garnishing the wages of the debtor, and you will find a familiar answer - 'we do not give legal advice'.
The fastest way to get all of the information about the debtor is a process called skip tracing. Part of this process involves finding credit report information on the debtor, and playing private detective to connect all of the dots in the case. One of the obstacles a collector will face is that almost all credit reporting agencies won't let you retrieve a credit report on someone if you don't own or operate a legitimate company that complies with FRCA laws and regulations.
If you use a collection agency service, they will collect your money for you with with no out-of-pocket fees, and absolutely no fees unless the money owed to you is recovered. Unlike lawyers who charge a per hour fee, whether or not they are able to collect your fees.
We recommend letting a professional National Collection Agency handle your outstanding debts for the most effective and efficient no-upfront cost way to collect on monies owed to you.
